What do these departments of government have in common?

The U.S. Department of Labor, Wage, Hour and Public Contracts Division, The Department of Commerce, Internal Revenue Service, State Office of Licensing, State Tax Commission, Department of Workforce Services, Local Zoning Office, The County Assessor, The Bureau Of Criminal Identification, US Customs and Exporting Offices, The Department of Alcoholic Beverage Control and of course you must hire an Attorney.

The above are all service providers, or at least that’s what they claim to be. I have wondered exactly what service it is they provide. Unless theft, intimidation, and violence are some wonderful services that I have mistakenly misunderstood I just do not find value in hiring someone to rob me, even when they threaten me.

When you are not satisfied with a service provider you usually have some choices. We can seek another individual or organization who can better provide the product or service or, we can simply choose to not use the product or service at all. Continuing to interact with any provider that’s unsatisfactory is something most would not do voluntarily, especially if said service is not provided.

When the services we trade to make a living are subject to being protected by the State, what is it that I would be expected to do in order to lawfully contract with other individuals in the state?

REGISTRATION OF A BUSINESS NAME
All persons or partners doing business under an assumed business name must register with the Department of Commerce.

STATE BUSINESS LICENSE
Under certain circumstances, a special state business license may be required for your business.

CITY COUNTY BUSINESS LICENSES
Business licenses may or may not be required by cities or counties throughout the state. Contact your local City or county office for details.

FEDERAL EMPLOYER’S TAX I.D. NUMBER
Every person without a previous tax number who pays wages to one or more employees or is required o file any federal reports must apply for a tax number on Form SS-4 with the IRS.

FEDERAL TAX INFORMATION
Contact the IRS for information related to income, excise, self-employment and other federal taxes.

MINIMUM WAGE LAWS
Many businesses are subject to federal minimum wage, overtime and child labor law regulations. For information, contact the U.S. Department of Labor, Wage, Hour and Public Contracts Division.

STATE CHILD CARE
Contact the State Office of Licensing if you plan on opening a child care/day care center at your home or in a commercial location.

STATE TAX INFORMATION & EMPLOYER’S TAX I.D. NUMBER

If you sell cigarettes and/or tobacco you must obtain a license from the State Tax Commission.

ZONING
Contact your local zoning office to unsure that your business location is properly zoned for commercial use.

PROPERTY TAXES
Property taxes are levied on land. building and equipment used in business. For information contact the County Assessor.

BULK SALES ACT
When purchasing a business, the purchaser is potentially subject to liability for all debts of the acquired business. Compliance with the Utah Bulk Sales Act is a means of limiting this liability. Seek competent legal advice in order to comply with this act.

ALCOHOLIC BEVERAGE CONTROL
Contact the State Department of Alcoholic Beverage Control if you plan on selling ANY ALCOHOL OR BEER on premise.

BUREAU OF CRIMINAL IDENTIFICATION
Contact BCI for a criminal history disclosure, i.e. felony or misdemeanor citations, etc.

IMPORT/EXPORT LICENSING
If you are interested in either importing or exporting you will want to check with US Customs and Exporting for rules and regulations.
